建立和完善产品召回制度对于保护消费者权益、企业利益以及公众利益等都具有重要意义。自

60
年代，产品召回制度在欧美等发达国家陆续建立并发展起来。而我国产品召回立法较晚，目前还仅局限在汽车、玩具、食品某类特殊产品的召回立法，在召回的实施过程中还存在着立法层级低、缺陷信息不能有效获取及缺陷调查困难等诸多问题。
本文以我国产品召回制度的立法为背景，比较分析欧美等发达国家在产品召回制度上的立法经验及先进做法，分析我国产品召回制度在运行情况及保障其有效运行的技术支持体系，提出了我国现行召回制度在运行中存在的一些问题，并就完善我国产品召回制度提出了具体建议。全文共分五章对产品召回制度进行分析。
第一章阐述了建立和完善我国产品召回制度的意义。介绍了国外产品召回制度研究进展情况及本文的主要研究内容，对全文的主体框架进行了介绍。
第二章分别对美国、欧盟产品召回制度进行阐述，对其立法背景、法律特征、产品召回管理机构及职能等进行比较分析；通过对国外产品召回监管实践与经验的比较分析，排除其国别差异等个性要素，探索欧美产品召回监管中的一般规律和共同趋势。
第三章对我国产品召回制度的法律机制进行阐述，对我国产品召回制度存在的问题进行反思，并提出完善我国产品召回制度立法的相关建议。
第四章对产品召回管理的信息平台、产品伤害监测技术体系、产品召回管理风险评估分别进行了阐述，对国外相关技术支持进行了介绍，并提出了我国产品召回运行体系的构建意见。
第五章提出缺陷产品召回制度是一项系统的工程，需要更应注重产品安全问题，加大缺陷产品召回监管力度，从缺陷产品信息收集、缺陷产品风险评估到产品安全风险预警等各个环节来不断完善我国产品召回监管体系。

Abstract
Establishment and improvement of defective product recall system are all of great significance for the protection of consumer interests, business interests and public interest. Since 60 years 20th century, the defective product recall system in Europe, America and other developed countries has been established and developed . In China , the legislation for recall defective products begin to be established, currently limited to only cars, toys, food product recalls of certain special legislation. During the implementation of the recall process, there are still some problems including legislative level is low, defects and defect information can not be effective for investigation difficult, and many other issues.
In this paper, based on comparative analysis of product recalls in Europe
，
America and other developed countries in the institutional practices of legislative experience, and on the analysis of the defective product recall system in operation to ensure their effective operation and technical support system, this paper points out some problems in the product recall system in china and conclude some recommendations on how to improve the product recall system made specific recommendations in china. Based on the above ideas, the text is divided into five chapters.
The first chapter describes the significance of establishment and improvement of defective product recall system in china. Introduction of foreign product recall system progress and main contents of this paper, the main frame of the full text was introduced.
Chapter II, based on a comparative analysis of product recall system of the United States and EU, elaborate their legislative background, legal characteristics, product recall management organizations etc.through the regulatory practices of foreign product recalls, compared with their experience, excluding differences in individual elements of each country, Chapter II explore the general rules and common trends of the supervision of product recalls in Europe and America.
Chapter III elaborates the legal origin of product recall system in china, point out the problems on China's current construction of the system and propose legislation recommendations to improve the product recall system.
Chapter IV describes information platform, product injury surveillance technology system, product recall management risk assessment respectively, to support the effective operation of management system for recall defective products. Foreign technical support also were introduced, and propose some recommendations for China product recall running System.
Chapter V point out that defective product recall system is a systematic project, the need should focus on product safety recall of defective products to increase supervision. To continuously improve the product recall regulatory system, we should take more measures including information gathering from defective products, product safety risk assessment, risk warning of defective products, etc.
