摘 要
随着改革的深化、经济的发展,现阶段我国社会的主要矛盾为人民群众日益增长的物质文化需求和落后的社会生产力,而在食品的数量和品种日益丰富下,食品安全问题日渐成为人们关注的焦点。“民以食为天,食以安为先”是中国人的一句老话,食品是人类赖以生存和发展的基本物质基础,它既是老百姓最重要的生活内容,其安全性也是政府的重要职责之一。
近年来,我国具有食品安全知识的消费者逐渐增多,公众的食品安全意识也逐渐提高,为保证食品质量安全,保障公众身体健康和生命安全,我国政府不断建立健全食品安全监管体系和制度,然而,近来我国的食品安全问题层出不穷,每年频频出现的重大食品安全事件,不仅严重影响到了人们的身体健康,造成了巨额的财产损失,而且也影响到了中国的经济发展、食品出口、社会稳定等一系列问题。目前,我国省一级的食品安全监管体制改革和职能转换已基本完成,市县级的改革也正在完善之中。在一些地方,由于多方面的原因,食品安全监管工作在机构改革中出现了监管不到位或监管缺位的现象。因此,如何保障食品安全问题亟待我们一起探讨和解决。
本文以监管体制的改革为背景,从百姓生活和政府职责角度出发,以“瘦肉精”、“染色馒头”为个案,分析我国食品安全制度和体系的建立以及我国食品安全监管存在的漏洞。然后提出完善食品安全监管的几点建议。本文在分析食品安全监管的应有要件和综合考察国际上诸多国家在食品安全监管行政执法上的先进做法和优秀的立法经验,并在分析我国当前制度和立法现状的基础上,提出了改革、完善现有的食品安全法律体系和行政执法体系的意见和建议。即从法律和制度两方面入手,通过《食品安全法》这一基本法的制定,统一规定保证食品安全的相关制度;在法律完善的基础上,理顺监管体制,构建一个法治、高效的食品安全监管体系,以期实现食品安全监管行政执法的目标要求:控制食品安全隐患,保证食品安全。

Therefore, how to guarantee food safety problems needmg to be together we discussed and solved.
